The Receiver hereby provides all potential claimants of the Zilmil, Inc. Receivership Estate with notice of two proposed settlements— (1) between the Receiver and Defendant Shah and (2) between the Receiver and Defendant Shah's relatives Eric Shah, Manoj Shah and Sujata Shah. Potential claimants interested in reviewing the terms and conditions of those settlements may review the Joint Motions to Approve Settlements, the Settlement Agreements attached as Exhibits A thereto, the Proposed Orders Approving the Settlements attached as Exhibits B thereto, and the Order setting a telephone hearing on the Joint Motions via the hyperlinks below:

The Receiver further provides notice that as part of the proposed settlement, defendants Eric Shah, Manoj Shah and Sujata Shah seek an Order from the Court, called a “Bar Order”, which will enjoin all parties in this case and all persons who receive actual notice of this case and the proposed settlement and Bar Order, from bringing any claims against these defendants that relate to their dealings with Zilmil, Inc. and Michael Shah.

FILE A CLAIM

In order to recover funds to which you may be entitled as an Eligible Claimant (as defined in the Legal Notice of Claims Administration Process and Plan of Distribution (the “Legal Notice”) [ECF # 229-1]) in this CFTC enforcement action, you must complete a Proof of Claim and Release Form and sign it under penalty of perjury where indicated. If you are NOT an Eligible Claimant, as that term is defined in the Legal Notice, DO NOT submit a Proof of Claim.

The deadline to file a claim in this matter has passed. No additional claims are being accepted at this time. The Receiver has commenced the claims review process and will send all claimants that have filed an online claim with supporting documentation an email informing them of the amount of their allowed claim by January 22, 2020.

HEARING ON BAR ORDER
The Receiver further provides notice that the Court will conduct a telephone hearing on these motions on October 27, 2020 at 4:00 p.m. Any party who objects to the proposed settlement or the Bar Order may appear at the telephone hearing to voice their objections by following the instructions in this Order. The conference line will be activated at 3:50 p.m. so the hearing may start promptly at 4:00 p.m. The Courtroom Deputy will email the call-in information to counsel of record using the email addresses listed on the Court’s docket for this case. Anyone who wishes to be heard at the hearing or members of the public or press who wish to listen to the proceedings may email the Courtroom Deputy at Marielena_Diaz@flmd.uscourts.gov to receive the call-in information.
